Effective Date: April 1, 2026
This End-User License Agreement ("Agreement") is a legal agreement between you ("User") and AI Trip Tracker ("Licensor") for the use of the AI Trip Tracker software application and related services ("Software"). By installing, accessing, or using the Software, you agree to be bound by the terms of this Agreement.
Grant of License
Subject to the terms of this Agreement and your active subscription, the Licensor grants you a:
- Personal license to use the Software for your own travel management purposes.
- Non-exclusive license, meaning the Licensor may grant similar licenses to other users.
- Non-transferable license that may not be assigned, sublicensed, or shared with third parties.
- Revocable license that remains in effect for the duration of your subscription or until terminated under this Agreement.
Restrictions
You may not:
- Copy, modify, or create derivative works based on the Software.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software.
- Rent, lease, lend, sell, or sublicense the Software or your access to it.
- Remove, alter, or obscure any proprietary notices, labels, or marks on the Software.
- Use the Software to build a competing product or service.
- Use the Software in any manner that could damage, disable, or impair the Licensor's servers or networks.
- Use automated tools to scrape, harvest, or extract data from the Software beyond your own itinerary data.
Ownership
The Software, including all code, design, algorithms, AI models, documentation, and associated intellectual property, is and remains the exclusive property of the Licensor. This Agreement does not grant you any ownership interest in the Software. Your itinerary data and personal information remain your property, subject to the terms of our Privacy Policy.
Updates
The Licensor may, from time to time, release updates, patches, or new versions of the Software. These updates may be applied automatically and are subject to the terms of this Agreement. As a web-based PWA, updates are delivered seamlessly through the browser without requiring manual installation. The Licensor is under no obligation to provide updates but will endeavor to maintain and improve the Software for active subscribers.
Termination
This Agreement is effective until terminated. It will terminate automatically if you fail to comply with any of its terms. The Licensor may also terminate this Agreement at any time by disabling your access to the Software. Upon termination:
- Your right to use the Software ceases immediately.
- You may request an export of your personal data within 30 days.
- The Licensor may delete your account data after the 30-day period.
- Sections regarding Ownership, Disclaimer of Warranties, Limitation of Liability, and Governing Law survive termination.
Disclaimer of Warranties
The Software is provided "AS IS" and "AS AVAILABLE" without warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Licensor does not warrant that:
- The Software will meet your specific requirements.
- The Software will be uninterrupted, timely, secure, or error-free.
- AI-parsed itinerary data, flight statuses, or delay predictions will be accurate or complete.
- Any defects in the Software will be corrected within a specific timeframe.
Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall the Licensor be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Software. The Licensor's total cumulative liability shall not exceed the total amount you have paid for the Software in the 12 months preceding the claim.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which the Licensor operates, without regard to its conflict of law provisions. Any disputes arising under this Agreement shall be resolved through binding arbitration or in the courts of competent jurisdiction. By using the Software, you consent to the jurisdiction of these courts.
